Booking terms and conditions for Creel Cottage, Dairy House, The Old Cheeseloft and Byre by the Sea Holiday Cottages & The Retreataway.
By booking and paying a deposit confirms that you have read and are satisfied to agree to our terms and conditions as detailed.
The owner means DJ&SD Dale-Sunley.
The Customer is the individual person who has made the booking for Creel Cottage, Dairy House,The Old Cheeseloft, Byre by the Sea or The Retreataway.
The Tenants are the people who attend with the customer. (The group).
The Booking Contract.
When you submit a booking via our online reservation system you will receive an automatically generated booking summary by email to the email address you provide in the booking form. This does not form a contract between us. A contract shall only arise when your booking is subsequently confirmed in writing via a letter of confirmation sent to you by post or email.
A contract will be formed between the owner and the customer when the customer has paid a deposit, funds are cleared and then the booking is secured.
General Terms.
1) Creel Cottage, Dairy House, The Old Cheeseloft, Byre by the Sea and The Retreataway are let for holiday cottage use and the customer will occupy Creel Cottage, Dairy House The Old Cheeseloft, Byre by the Sea or The Retreataway for the purpose of a holiday only. (Refer to section 12 (2), paragraph 8 schedule 4 Housing (Scotland) act 1988 this applies to Creel Cottage, Dairy House ,The Old Cheeseloft, Byre by the Sea and The Retreataway).
2) Creel Cottage, Dairy House ,The Old Cheeseloft, Byre by the Sea and The Retreataway will be used by the customer and their group only, and no sub-letting shall occur at any time. No additional persons shall expect to occupy Creel Cottage, Dairy House ,The Old Cheeseloft or Byre by the Sea than agreed at the time of booking and payment.
3) The owners would respectfully request that Creel Cottage, Dairy House ,The Old Cheeseloft, Byre by the Sea or The Retreatway are vacated by 09.00am on the morning of departure and the group does not arrive until 4pm. (Unless prior agreement / arrangements have been made with the owners.)
4) The owners would respectfully request that the customer and their group leave Creel Cottage, Dairy House ,The Old Cheeseloft, Byre by the Sea or The Retreataway in a clean respectable condition. The owners reserve the right to make a charge for additional cleaning if the property is left in an unacceptably dirty manner as determined by them.
5) The owners would respectfully request that any breakages, damages or losses are reported to them and where deemed appropriate or reasonable the customer pay or contribute to a replacement.
6) A booking may be deemed cancelled if full payment is not received 4 weeks prior to commencement of the holiday (unless it is a late booking).
7) The customer and their group will act reasonably, responsibly and considerately whilst on their holiday in Creel Cottage, Dairy House, The Old Cheeseloft, Byre by the Sea or The Reteataway.
8) The owners accepts no responsibility for loss, injury or damage to any member of the customers group or their property however this may have arisen or occurred. Vehicles are left at guests risk.
9) The customer and their group agree to indemnify the owners from any liability whatsoever whilst holidaying at Creel Cottage, Dairy House, The Old Cheeseloft, Byre by the Sea or The Retreataway.
10) RRoss farm is a working farm with machinery and animals, the owners would request that neither the customer nor any of their group enter any of the farm buildings for any reason and any time. A Plan will be present within Creel Cottage, Dairy House ,The Old Cheeseloft , Byre by the Sea and The Retreataway showing “no go areas for your safety.”
11) As Ross Farm will have animals on some of the fields some of the time the owners would respect that the customers and their group are aware of this and do enter at their own risk. You may wish to see the animals close up but they may not wish to see you especially if they have youngsters at foot!
12) Please avoid taking dogs into fields with cows and young calves, (the cows may be overprotective and could be aggressive).
13) We allow 2, clean, well behaved dog into Creel Cottage, Dairy House, The Old Cheeseloft, Byre by the Sea or The Retreataway providing it brings its own bedding and is never left in the home alone. There is a charge of £20.00 per week for a dog. We have an outside tap for washing dirty paws, and can provide a dog crate for inside the cottages should you require.
14) The owners may have access to Creel Cottage, Dairy House,The Old Cheeseloft, Byre by the Sea or The Retreataway at all reasonable times.
15) The customer and their group will close all exterior windows, and doors and secure the property when they are absent.
16) To minimise fire risk we do not permit the use of candles in Creel Cottage, Dairy House, The Old Cheeseloft, Byre by the Sea or The Retreataway except for emergency use. The customer and their group are asked to minimise any fire risks.
17) Creel Cottage, Dairy House ,The Old Cheeseloft, Byre by the Sea and The Retreataway are no smoking cottages, please respect this policy.
18) We have many links on our web site to places of interest and enjoyment, however we cannot be held responsible for your experience at any of them. (However we have visited many with delight).
19) Should you have any problems or complaints please discuss them with us and if it was all good please pass on the word.
Fees and cancellations.
1 - Your deposit confirms your booking and is £150.00 for Creel Cottage, Dairy House ,The Old Cheeseloft, Byre by the Sea and The Retreataway (£100) for 1 week. (ie 2 weeks deposit would be £300.00 or £200 respectively).
2 - You can pay in full anytime from paying your deposit to 4 weeks before arrival but we will give you a date by which the full payment should be made.
3 - The whole deposit is forfeited if you do not make full payment by the due date and the owner can re-let Creel Cottage, Dairy House, The Old Cheeseloft, Byre by the Sea or The Retreataway.
4 -If the customer wishes to cancel their holiday at Creel Cottage, Dairy House ,The Old Cheeseloft, Byre by the Sea or The Retreataway then they can have their deposit refunded if they cancel in writing within 7 days from the date of booking and paying the deposit. Any cancellation by the customer after the 7 days for any reason will result in full forfeit of the deposit.
5 - Once full payment is received, should the customer cancel their holiday at Creel Cottage, Dairy House ,The Old Cheeseloft, Byre by the Sea or The Retreataway up to 28 days prior to the arrival date they will forfeit 60% of the balance paid, and from 28 days to 14 days prior to the arrival date they will forfeit 85% of the balance paid. Any cancellations made within 14 days of arrival date then the whole balance will be forfeited.
6 - We strongly advised you to have holiday insurance cover / cancellation insurance in place so that you are covered for the unavoidable which can happen. If you choose not to have holiday / cancellation insurance please be aware of the penalties as described above.
7 - Should we, the owners need to cancel your holiday for any reason whatsoever we will contact you immediately. We will give you a full refund, or the opportunity to rebook another time, however we cannot offer you any alternative accommodation as we have only Creel Cottage, Dairy House The Old Cheeseloft, Byre by the Sea or The Retreataway to let.
Disclaimer.
The owners have tried to accurately describe Creel Cottage, Dairy House, The Old Cheeseloft, Byre by the Sea and The Retreataway and their surroundings and the photographs in the gallery have been taken at Ross.
Should any term within this contract not be permissible by law then the remainder of the contract shall remain valid.
The contract is subject to Scottish Law and the contract was formed at Ross Bay Retreat, Kirkcudbright.
This does not affect your statuatory rights.
